General Terms of Use

This translation is provided for convenience. In the event of any discrepancies, the German version shall prevail.

These Terms govern the use of SpielDock. They are designed for the website, web app and community, which are currently provided free of charge.

1. Scope and Provider

These Terms of Use apply to the use of SpielDock via spieldock.com and the associated web app.

They become part of the user agreement when they are brought to your attention during registration or use and you agree to their application.

The service provider and contractual partner is:

Individual agreements take precedence over these Terms.

2. Scope of SpielDock Services

SpielDock is a platform for board game enthusiasts.

Depending on the current stage of development, you can in particular discover games, manage collections and wishlists, submit ratings, record game sessions, use profiles and connect with other members.

The service currently offered is free of charge.

Support payments made via external platforms are voluntary and do not unlock additional features.

If SpielDock introduces paid services in the future, separate terms and pricing information will be provided before any such service is purchased.

3. Registration and Account Security

• Certain features require a personal user account. Information required during registration must be accurate.
• Login credentials must be kept confidential and must not be shared with other people.
• If you suspect unauthorised access to your account, please notify us immediately.
• Use of SpielDock requires you to be legally capable of entering into the user agreement. Where required, minors need the consent of their legal representative.

4. Community Rules

SpielDock is intended to provide a friendly and helpful environment for interaction.

Treat other people with respect and remember that there is a real person behind every profile.

In particular, content or conduct is not permitted if it:

• violates applicable law or promotes unlawful activities;
• threatens, insults, harasses, deliberately degrades or discriminates against others;
• glorifies or promotes hatred, violence, self-harm or dangerous behaviour;
• is pornographic or contains sexualised depictions without sufficient authorisation;
• infringes the rights of others, including copyright, trademark, personality or data protection rights;
• distributes spam, unsolicited advertising, fraudulent offers, malware or misleading information;
• falsely represents an identity or a non-existent relationship with a person, publisher or company;
• interferes with the security, availability or proper functioning of SpielDock or circumvents technical safeguards.

5. Ratings, Comments and Your Own Data

5.1 Responsibility and Rights

SpielDock allows you to submit ratings and comments on games and to manage your collection, wishlist and digital game passes.

Independent posts, images or videos cannot be published.

You are responsible for the text of your comments. Any existing rights to your comments remain with you.

5.2 Processing Within the Features

In order to provide the respective features, we may store and process your ratings, comments, collection information and game-pass information and display them according to the intended visibility.

Where a comment is protected by copyright, you grant us, for the duration of its availability, a simple, royalty-free and geographically unrestricted licence to perform the technical acts necessary to provide these features.

We may use carefully selected technical service providers for this purpose.

Your comments will not be used for advertising or disclosed to partners for their own purposes without separate permission.

5.3 Deletion

If you delete a comment or your account is terminated, the licence granted for that content ends unless temporary storage is required for legal or technical reasons.

Backup copies are removed as part of the regular deletion cycle.

Ratings and comments may be anonymised after account deletion in accordance with the Privacy Policy.

6. Information About Other People

Game sessions and free-text fields may contain information about other players.

Only enter personal information about other people if you are authorised to do so.

Where possible, use nicknames and avoid unnecessary or sensitive information.

7. Reports and Moderation

You can report unlawful comments, prohibited information and violations of these Terms to support@spieldock.com.

Where possible, identify the affected comment or data record, provide the direct link, explain the reason for the report and provide a means of contact for follow-up questions.

Depending on the nature, severity and frequency of a violation, we may restrict the visibility of or remove comments or information, restrict features, issue a warning or temporarily or permanently suspend an account.

When making such decisions, we take the context into account and act carefully, objectively and proportionately.

Where legally permissible and where contact details are available, we inform affected users about significant moderation decisions and the reasons for them.

Objections to a decision may be sent to the contact address stated above.

Security measures and simple technical filters, such as anti-spam measures, may operate automatically. Complaints are not decided exclusively by automated means.

8. Availability and Further Development

SpielDock is continuously being developed.

In particular during the Open Beta, features may be incomplete, change or temporarily be unavailable.

Maintenance, security measures or technical disruptions may further restrict availability.

There is no entitlement to uninterrupted availability or to the permanent continuation of a particular free feature.

However, significant changes will not be made arbitrarily and will take the legitimate interests of members into account.

Where the respective feature allows it, you should additionally back up important information of your own.

9. Termination and Account Deletion

You may stop using SpielDock at any time and request deletion of your account using the contact method described in the Privacy Policy.

We may terminate a free user agreement by giving reasonable notice.

The right of either party to terminate for good cause remains unaffected.

Good cause may exist in particular in the event of serious or repeated violations of these Terms, security risks or measures required by law.

10. Rights to SpielDock and Game Information

Software, design, logos and content created by SpielDock are legally protected.

Reproduction, modification or distribution beyond the intended use of the platform is permitted only where allowed by law or with prior consent.

Names, images, trademarks and other information relating to board games may be protected by rights belonging to the respective publishers, manufacturers or other rights holders.

Their display serves informational and collection-management purposes.

No business relationship exists unless expressly stated.

11. Liability

We are liable without limitation in cases of intent and gross negligence, for damage arising from injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz), and to the extent of any expressly assumed guarantee.

In the event of a slightly negligent breach of an essential contractual obligation, liability is limited to damage that is typical for the contract and foreseeable at the time the contract was concluded.

Essential contractual obligations are obligations whose fulfilment is necessary for the proper performance of the user agreement and on whose compliance the user may regularly rely.

Otherwise, liability for slight negligence is excluded.

These provisions apply accordingly to our legal representatives and persons engaged by us to perform our obligations.

12. Data Protection

Information about which personal data SpielDock processes, the purposes for which it is processed and the rights available to you can be found in our Privacy Policy.

13. Changes to These Terms

We may amend these Terms if laws, case law, security requirements or SpielDock features change.

We will provide timely notice of material changes in an appropriate form.

If a change requires your consent, we will obtain it.

Until then, the previous provisions remain applicable to the existing user agreement.

14. Consumer Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

15. Final Provisions

German law applies.

If you are a consumer and your habitual residence is in another country, mandatory consumer protection provisions of that country remain unaffected.

If any individual provision is or becomes invalid, the remaining provisions remain unaffected.

The invalid provision shall be replaced by the applicable statutory provisions.
